By installing the Encircle macOS client and utilizing our services, you agree to these Terms. Encircle provides software that facilitates hosted AI analysis on crop selections from your screen. Abuse, bot-like activity, or reselling our endpoints is strictly prohibited.
1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Encircle application, website, and API service endpoints (collectively, the “Service”).
By downloading our client software, creating a user account, or subscribing to our plans, you represent that you have read, understood, and agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you confirm you have the authority to bind that entity.
2. Service Description and License
Encircle is a native macOS productivity tool that captures selected screen regions and routes those images along with user-typed prompts to third-party artificial intelligence models for context explanation and follow-up discussion.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and install the Encircle application client on compatible Mac computers that you own or control.
3. User Accounts and Security
You must register an account to access our hosted AI infrastructure. We rely on Clerk for account setup and authorization.
You agree to supply accurate registration information and keep it updated. You are solely responsible for maintaining the confidentiality of your session tokens and credentials, and for all activities that occur under your account. Please notify us immediately if you suspect unauthorized account access.
4. Billing, Subscriptions, and Payments
Access to Encircle Pro is billed on a recurring subscription basis. Payment collection, invoice processing, and local tax compliance are managed via our merchant of record, Dodo Payments.
- Renewal: Your subscription automatically renews at the end of each billing period (monthly or annually) unless you cancel your plan prior to the renewal date.
- Cancellation: You can manage or cancel your plan through your account settings or payment receipt portal.
- Refunds: Payments are non-refundable except as required by law or as expressly specified by Encircle support policies.
5. Fair Use and Usage Limits
Inference Cap policies:
To prevent system overload and commercial abuse, we apply soft Caps: Encircle Pro includes hosted access estimated up to 1,200 queries per month, with a standard limit of 40 daily queries. Usage exceeding limits may result in temporary throttling or requires custom enterprise plans.
You may not automate query generation, run automated scripts to interact with the API, or wrap the client software to distribute hosted AI responses to third parties.
6. Intellectual Property
Except for user-submitted text and screen selections, all materials related to the Service (including UI design, visual brands, logos, hosted software code, and server configurations) are the property of Encircle.
We do not claim ownership over the screen selections or questions you input into the Service. You grant us a limited, worldwide license to transmit and process your input metadata strictly for the purpose of returning AI answers to you.
7. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ENCIRCLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, COMPLETELY SECURE, OR ACCURATE, NOR DO WE WARRANT THE STABILITY OR CORRECTNESS OF RESPONSES GENERATED BY HOSTED LLM INFRASTRUCTURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ENCIRCLE BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR USE) ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR HOSTED API, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles.
